Tender for unitized non contracted areas

The PPSA is launching the process for the sale of the Federal Government’s entire tract participation (“TP”) in the Shared Reservoirs of Mero, Tupi, and Atapu, corresponding to the non-contracted areas located within the Pre-Salt Polygon in the Santos Basin.

The legal basis for this process is provided by Law No. 15,164, dated July 14, 2025, which authorizes the Federal Government to sell its rights and obligations arising from unitization agreements related to non-concession or non-production sharing areas within the pre-salt and other strategic areas.

The Auction of Non-Contracted Areas of the Shared Reservoirs of Mero, Tupi, and Atapu will take place on December 4, 2025, at B3 in São Paulo. The auction will offer the market the Federal Government’s entire participation in these areas, currently corresponding to 3.500% in Mero, 0.551% in Tupi, and 0.950% in Atapu.

Notice 3 : In accordance with items 214, 215, and 217 of the Public Notice, PPSA announces the publication of a revised version of the Notice, which can be found below along with a summary highlighting the amendments made. We emphasize that the deadline for the submission of Volume 1 has been extended to November 14, 2025.

Notice 2: The deadline for accessing the Data Package has been extended until 11:59 PM on November 14, 2025.

Notice 1: The deadline for submitting comments on the public notice has been extended until 11:59 p.m. on September 10, 2025.

The Letter of Introduction has been amended to reflect the increase in the number of representatives authorized to receive the Data Package and to specify the procedure for designating additional representatives exclusively for access to the Data Package in the In-Person Format.

DOCUMENTATION: The B3 system is open as of today (November 3, 2025) for accreditation and submission of Volume 1.

A Non-Contracted Area is one that is not linked to any existing contract — whether a concession, a transfer-of-rights, or a production-sharing agreement. When a reservoir extends into an NCA, an agreement with the Federal Government must be established to enable integrated production of the area. In such cases, PPSA acts as the Government’s representative in the negotiations, whenever the area is located within the pre-salt polygon or in regions deemed strategic. Even after the agreement is executed, ownership of the area remains with the Federal Government.
